At a recent conference of Chief Justices and Chief Ministers, Chief Justice of India proposed to set up a national judicial infrastructure corporation along with corresponding state level bodies but did not find favour with many Chief Ministers. This special purpose vehicle could have helped in augmenting the facilities for the judiciary, given the inadequacies in court complexes. However, there was an agreement with respect to the State level bodies for the same purpose.
This exercise will require greater coordination between the States and High Courts to implement this proposal. Moreover, the Union Law Minister has promised Centre’s assistance for creating the required infrastructure for the lower judiciary.
Furthemore, CJI Raman highlighted the Government’s contribution to judiciary’s burden- failure/unwillingness to implement court orders, thereby leaving the court to decide important questions. Also, litigation caused by action/inaction of the government forms a huge part of the court’s burden. This conversation at the judicial and executive level will bring about an atmosphere of cooperation.
