    National Institute of Mental Health & Neuro Sciences v C Parameshwara, 2005 This is one of the landmark cases in CPC concerning the principle of res-sub-judice and res-judicata as provided u/ss 10 and 11 of the Code of Civil Procedure 1908. S.10 of the Code, which deals with the principle of res sub judice, provides that no court shall proceed with the trial of a suit in which the matter in issue is directly and substantially in issue in a previously instituted suit between the same parties before another court of competent jurisdiction.
