In a criminal case, the primary burden of proof is upon the prosecution. The prosecution has the responsibility to prove beyond a reasonable doubt that the accused committed the crime with which they are charged. It is not the responsibility of the accused, police or court to prove the accused's innocence. While the police are responsible for investigating the crime and collecting evidence, it is ultimately the prosecution's responsibility to present that evidence in court and prove the case against the accused. The court's role is to evaluate the evidence presented by both sides and make a determination of guilt or innocence based on the standard of proof required by law.
