Section 114A of the Indian Evidence Act, 1872 deals with the presumption as to the absence of consent in certain prosecutions for rape. It was inserted into the Act by the Criminal Law (Amendment) Act, 2013, following the recommendations of the Justice Verma Committee. According to Section 114A, if the question is whether sexual intercourse was without the consent of the woman alleged to have been raped and she states in her evidence before the court that she did not consent, the court shall presume that she did not consent.
